With some of the latest events that have been happening in the news we at Calasanz Martial Arts have been asked questions about defending oneself and what and when it is appropriate to do so. We are not lawyers, or interpreters of the law, the following is what we believe to be true, as with anything please check with professionals on the subject.
The Castle Doctrine and Stand Your Ground Law.
It is our intent to give the reader a better understanding of The Stand Your Ground Law and the Castle Doctrine in Connecticut CT.
Basically your home is your Castle or in some states, any place legally occupied, such as a car or place of work as a place in which the person has certain protections and immunities and Connecticut law states that a person has no duty to retreat if they are in his or her home and may use reasonable force, this includes deadly force if necessary, to defend their property, themselves, or others.
Outside of your Castle or home, a person has a duty to retreat as long as they are able to before using reasonable force.
Stand-your-ground laws, remove the common law requirement to retreat outside of one’s home or Castle allowing an individual to use force in self-defense when there is reasonable belief of a threat. Deadly force is reasonable under stand-your-ground laws in certain circumstances, such as imminent great bodily harm or death.
Connecticut does not have a stand-your-ground law. Connecticut law specifically requires an individual to retreat, if able to do so, before using reasonable force.
Forty-six states, including Connecticut, have incorporated the Castle Doctrine into law. So what now…
